CUE Terms of Service

By accessing or using CUE, including CUEchats and community features like the CUE Credit system, you agree to these Terms of Service. CUE may be purchased at a discount exclusively via our website (through Stripe) or at full price via the Apple App Store or Google Play Store—the sole authorized purchase points. Non-compliance voids your authorization to use our services. These terms apply to all users, and you acknowledge that CUE’s proprietary content exceeds $5,000 in value under federal law.

  1. AMENDMENTS TO TERMS
  2. CUE reserves the right to modify these Terms at its sole discretion, effective immediately upon posting. Continued use of the services following such amendments constitutes your unqualified acceptance. The effective date above reflects the most recent revision.

  1. ACCOUNT REGISTRATION AND SECURITY
  2. You must provide accurate, current, and complete information during registration. You are solely responsible for safeguarding your account credentials and all activities under your account. Account sharing is prohibited. Report suspected unauthorized access to support@cuetheapp.com immediately.

  1. REFUND AND SUBSCRIPTION POLICY: USAGE-BASED AND STRICTLY ENFORCED
  2. CUE enforces a refund and subscription policy to ensure fairness and prevent abuse, tailored to membership type, billing cycle, and CUE Credit usage:

    Standard Purchases (Monthly, Semiannual, Annual):

    Refunds for purchases via cuetheapp.com (processed by Stripe) may be granted if:

    • Usage is minimal (fewer than six database queries, CUEchats messages, or CUE Credit redemptions, as tracked by CUE).
    • A legitimate basis is provided (e.g., persistent technical failure).
    • The request is submitted to support@cuetheapp.com within 14 days (7 days for monthly plans), with proof of issue.
    • Excessive usage voids eligibility. Subscriptions auto-renew unless cancelled 30 days (semiannual/annual) or 7 days (monthly) prior via support@cuetheapp.com; post-renewal refunds are unavailable.
    • App Store Purchases: Refunds via Apple App Store or Google Play follow their policies: Apple; Google.
    • Lifetime Memberships: Non-refundable except for egregious CUE-attributable failure (e.g., permanent inoperability). Lifetime access includes all features without credit requirements. Requests require zero usage and must be filed within 7 days with evidence.
    • Trial Periods: Trials, if offered, cap at 50 messages total, are non-refundable, and count toward refund limits.
    • CUE Credits: Non-refundable, non-transferable, expire after 12 months unless specified.
    • CUE’s refund decisions are final & flexible to ensure customer satisfaction & property protection.
  1. PAYMENT TERMS AND CUE CREDIT SYSTEM
  2. Payments are due in full at purchase via cuetheapp.com (Stripe, discounted), Apple App Store, or Google Play Store. Subscriptions bill at cycle start. Discounts apply only to website purchases.

    You are liable for all taxes and fees. Non-payment suspends access; CUE may pursue collection with costs.

    CUE Credit System: Earn credits by contributing approved CUE Lists, context cues, or content, redeemable for exclusive AI access. Subscribers need credits for some features; Lifetime users are exempt. CUE’s credit eligibility and value decisions are final and non-appealable. Rates and access may change without notice.

    Chargebacks bypassing CUE forfeit service rights and may incur fees.

  1. USE BY MINORS
  2. Users under 16 require verifiable parental consent. Guardians are liable for minors’ compliance.

  1. USER OBLIGATIONS
  2. You must provide truthful data, secure your account, and comply with laws, including U.S. export controls.

  1. PROHIBITED ACTIONS
    • You may not:
    • Use CUE illegally.
    • Disrupt service or security.
    • Copy or exploit CUE content without authorization.
    • Use bots or scrapers without consent.
    • Reverse-engineer CUE technology.
    • Create multiple accounts to bypass limits.Violations lead to termination and legal action.
    • Sharing accounts
  1. INTELLECTUAL PROPERTY AND CONFIDENTIALITY
  2. CUE’s technology, content, CUEchats, CUE Lists, context cues, and Explore page are proprietary and confidential under NDA standards (18 U.S.C. § 1831 et seq.). Unauthorized use incurs a $250,000 penalty per incident, plus fees and damages. CUE will prosecute fully.

  1. USER-GENERATED CONTENT AND COMMUNITY FEATURES
  2. Your contributions (e.g., CUEchats messages, CUE Lists) grant CUE a perpetual license for platform use. Content must meet CUE’s quality and relevance standards, determined solely by CUE, to earn credits or appear. You warrant legality; CUE may remove content at its discretion.

  1. SERVICE DISCLAIMERS
  2. CUE’s services are “as is,” for informational use only, not professional advice. CUE isn’t liable for third-party performance.

  1. LIMITATION OF LIABILITY
  2. CUE isn’t liable for damages beyond fees paid in the last 12 months, except for gross negligence, to the fullest extent of law.

  1. INDEMNIFICATION
  2. You indemnify CUE against claims from your use or breaches.

  1. GOVERNING LAW AND DISPUTE RESOLUTION
  2. Delaware law governs; disputes go to AAA arbitration in Delaware. Prevailing party recovers attorneys’ fees.

  1. SERVICE MODIFICATIONS
  2. CUE may modify services without notice; no refunds unless per Section 3.

  1. ACCOUNT TERMINATION AND OVERUSE POLICY
  2. Limits: Standard users: 50 CUEchats messages/day; Lifetime: unlimited. Overuse or multi-account evasion leads to suspension.

    Termination revokes all rights and credits; CUE may pursue remedies.

  1. FUTURE PLATFORMS
  2. These Terms apply to cuetheapp.com, cuewebapp.com, and any future desktop or web evolution of CUE, ensuring consistent governance across all access points.

  1. FORCE MAJEURE
  2. CUE isn’t liable for delays from uncontrollable events.

  1. SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT
  2. Invalid provisions don’t affect others. No waiver unless written. These Terms and Privacy Policy are the full agreement.
